Do you think it's important to get trademarks right away?

Hi All,

I can't tell you how many clients come to us after it's too late. They started their new businesses, began investing in support of their brands, marketing, PR, ads, etc. Then, when it they do not expect it, they are hit with cease & desist letters from competitors claiming infringement.

The trademark process should be handled before you make the big investment NOT afterwards.

Dear Frank,

Thank you very much for sharing your knowledge and offering support for newbies.

I have a plan and thinking over it for a long. But finally I realized this is enough thought processing, I should be physically a little more active.

I have two questions: I am willing to bring up a product in the market. Some basic research indicates the product is going to fly off. Of course I want to get it patented. However, before that, I would set up my own company so I can get the patent registered under company's name instead of exposing personal liabilities.

Now, sequentially, what are the steps I am supposed to take? Am I going to register for TM? or Patent? or Company's registration. Please also, if possible, clarify the difference among all of these.
