Assuming your asking for the advice:
Depending on your state's tax laws and pending any advice from your attorney or CPA, I would recommend visting legalzoom.com - very easy way to incorporate or begin as a LLC and it's inexpensive. In general, an LLC will give you excellent legal protection and by treating your LLC as an "S" Corp. (a federal tax election) it will give you multiple tax planning opportunities as a result of its "pass-through" status. I'm sure this sounds complicated but it's works well for most small businesses. One last tip, do not transfer any valuable assets (real estate, patents, intellectual property, etc) into your new entity - keep them separated. Use your LLC/Corp. as an operating entity only.
